Previously in Maryland, a couple looking to divorce would be required to wait one year without spending a night together, including providing witness testimony confirming the one year uninterrupted separation, before obtaining a divorce. However, our legislature has changed these laws. Couples that do not have minor children and have already reached a property settlement agreement can now divorce without any waiting period.
This new ground is referred to as “Mutual Consent” and is helping Maryland couples that agreed in writing upon property division, along with alimony and other related issues, obtain their divorce much quicker and easier. In addition, corroborating witnesses are no longer required for divorce proceedings. In the past, witnesses such as relatives were asked to take the stand to confirm the separating couple were truly separated and did not spend a night together. The new law requires only the spouse seeking the divorce to appear in court.
